Terms and Conditions of Use

Welcome to Rexarc's Spec-Gas 101- Introduction to Specialty Gas and Specialty Gas Distribution Equipment Online Training Program. This program has been prepared to provide you with training and basic technical knowledge of Specialty Gas and Specialty Gas Distribution Equipment.  This course has been prepared based on proper and safe methods that are currently accepted industry practices.

All data is for basic knowledge purposes only and is based on accepted industry tests and practices and on published data from standard reference works.

The accuracy or completeness of any information, tests, and or data is not warranted in any way.

By registering for Spec-Gas 101 (online training program) you agree to be bound by these Terms and Conditions of Use (this agreement), whether or not you complete the course. You may become an approved user by reading and agreeing to the following Terms and Conditions for Use.  If you disagree or object to anything in this agreement, do not register for this training program.

  1. Acceptance of Terms and Conditions of Use
    1. Electronic Agreement. This Agreement is an electronic contract that sets out the legally binding terms of your use of our website and training program.  This Agreement may be modified by Rexarc from time to time, such modifications to be effective upon posting by the Rexarc website.  This Agreement includes Rexarc’s Acceptable Use Policy, Privacy Policy, and any notices regarding the training program.  By accessing this training program or by registering, you accept this Agreement and agree to the terms, conditions and notices contained or referenced herein.
    2. Electronic Form. By accessing the training program and becoming a registered user, you consent to have this Agreement provided to you in electronic form.
    3. Non-Electronic Copy. You have the right to receive this Agreement in non-electronic form.  You may request a non-electronic copy of this Agreement.  To receive a non-electronic copy of this agreement, please send an e-mail stating your request to info@rexarc.com or a letter and a self addressed stamped envelope to: Rexarc Customer Service, P.O. Box 7, West Alexandria, OH 45381.
    4. Withdrawing Your Consent. You have the right at any time to withdraw your consent to Agreement.  

                                                              i.      Effect. Should you choose to withdraw your consent, we will discontinue your username and password.  This means that you will not have the right to use this training program or service unless, and until, we issue you a new username and password.  We only will issue you a new username and password after we receive a signed copy of a non-electronic version of this Agreement, which we will send to you upon request. You may be required to re-register.

                                                            ii.      Notice. To withdraw your consent and/or to request a non-electronic copy of this Agreement, please send an email stating your request to info@rexarc.com or a letter and a self addressed stamped envelope to: Rexarc Customer Service, P.O. Box 7, West Alexandria, OH 45381.

                                                          iii.      Prospective Nature. Your withdrawal of consent shall be effective within a reasonable time after we receive your withdrawal notice described above.  Your withdrawal of consent will not affect the legal validity or enforceability of the Agreement provided to, and electronically signed by you prior to the effective date of your withdrawal.

    1. Access and Retentions. In order to access and retain this electronic Agreement, you must have access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access.  In addition, you must use all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.  Please print a copy of this document for your records.  To retain an electronic copy of this Agreement, you may copy and save it into any word processing program.  Via, the website we will notify you of any changes in the hardware or software requirements needed to access and/or retain this Agreement that create a material risk that you will not be able to continue to access and/or retain this electronic Agreement.
  1. Eligibility. You must be at least eighteen (18) years of age to use this training program.  Rexarc reserves the right to refuse anyone registration for any reason and any purpose without explanation.  You may become a registered user of Spec-Gas 101 at no cost.  As a user you will have access to training modules as well as the supplemental materials.  
  2. Term. This agreement will remain in full force and effect while you use this Website and/or Spec-Gas 101 online training course.  You may terminate your username at any time, for any reason, by sending an email to info@rexarc.com with the subject heading CANCEL TRAINING. If you terminate your user name, your account will be terminated within 24 hours.  Rexarc may terminate your username and/or account for any reason by sending you a notice to you at the email address you provided upon registration. If Rexarc terminates your account because you have breached this Agreement or told any falsehoods on your registration application, you are not entitled to any further service use. All decision regarding termination of accounts shall be made in the sole discretion of Rexarc International, Inc. Rexarc is not required to provide you notice prior to terminating your account.  Even after your account is terminated, this Agreement will remain in effect.  All terms that by their nature may survive termination of this Agreement shall be deemed to survive such termination i.e. copyright, security, etc.
  3. Non-Commercial Use by registrants.  This Website and Training Service is for personal use of individual users only and may not be used in connection with any commercial endeavors.  Organizations, companies, and/or businesses may not become registered users.  Illegal and/or unauthorized uses of this website and/or online training program, including but not limited to collecting usernames and/or email addresses of other users by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the website may be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.  Use of this Website and/or Spec-Gas 101 online training program is with the permission of Rexarc International, Inc., which may be revoked at any time, for any reason, and in Rexarc’s sole discretion.
  4. Account Security. You are responsible for maintaining the confidentiality of your username and password that was issued to you upon approved registration.  You are fully responsible for all the activities that occur under your username and password. You agree to (1) immediately notify Rexarc International, Inc., of any unauthorized use of your username or password or any other breach of security, and (2) ensure that you exit from your account at the end of each session. Rexarc will not be held responsible for any loss of information arising from your failure to comply with this provision.
  5. Cheating. You may not at any time let another user or another person complete your course and/or tests for you or on your behalf. Non-compliance with this provision will result in immediate account termination.
  6. Content on Rexarc.com and Spec-Gas 101 Online Training Program. Rexarc International, Inc. owns and retains all proprietary rights in the Website and for the Spec-Gas 101 training service.  The Website contains the copyrighted material, trademarks, and other proprietary information of Rexarc International, Inc., and its licensors. Except for that information that is public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.  
  7. Prohibited Activities.  Rexarc reserves the right to investigate and terminate your membership if you have misused the Website or the training program, or if you have behaved in a way which could be regarded as inappropriate or whose conduct is unlawful or illegal.  The following is a partial list of the type of actions that you may not engage in with respect to the Spec-Gas 101 online training service.
    1. You will not impersonate any other person or entity.
    2. You will not lie on your registration application.
    3. You will not express or imply to anyone that any statements your make are endorsed by Rexarc without our specific prior written consent.
    4. You will not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of the training program or its contents.
    5. You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
    6. You will not remove any copyright, trademark or other proprietary rights notices contained in this training program.
    7. You will not post, email or otherwise transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
    8. You will not frame or mirror any part of this training program or the Rexarc website without Rexarc’s prior written authorization.  You also shall not use Meta tags or code or other devices containing any reference to Rexarc or the Training or the site in order to direct any person to any other website for any purpose.
    9. You will not modify, adapt, sublicense, translate, sell, reverse, engineer, decipher, decompile, or otherwise disassemble any part of the Rexarc Website or it’s Spec-Gas 101 online training program or any software used on or for Rexarc’s Website and/or Spec-Gas 101 program or cause others to do so.  
  8. Customer Service. Rexarc is and has always been dedicated to providing our customers with the greatest customer service.  When communicating with our customer service representatives, you may not be abusive, obscene, profane, offensive, sexist, threatening, harassing, racially offensive, or other wise behave inappropriately.  If we feel that your behavior towards any of our customer service representatives or other employees is at any time threatening or offensive, we reserve the right to immediately terminate your account.
  9. Current Information Required.  YOU MUST PROVIDE CURRENT, COMPLETE AND ACCURATE INFORMATION TO REGISTER TO USE SPEC-GAS 101.        
  10. Changes to Spec-Gas 101. Rexarc International reserves the right at any time to modify or discontinue, temporarily or permanently, the training service or any part of it, with or without notice.  You agree that Rexarc is not liable to you or to any third party for any modification, suspension or discontinuance of the Service.
  11. Copyright Policy. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.  Without limits if you believe that your work has been copied and posted on Rexarc’s site, please provide a copy of the Copyright Certificate to Rexarc International, Inc., P.O. box 7, West Alexandria, OH 45381.  Please include copyrighted material, copyright certificate, your name, address, phone number, email address, description of where the material you claim is infringing is located on the website and a self addressed stamped envelope for response.
  12. Blocking IP Addresses. In order to protect the integrity and uniqueness of our service, we reserve the right at any time in our sole discretion to block users from certain IP addresses from accessing our website and services.
  13. Privacy. Use of the website and/or any service on it is also governed by our Privacy Policy.
  14. Disclaimers. All data on this site is for basic knowledge and basic technical purposes only. It is based on the generally accepted tests and practices and on published public data from standard reference materials. The accuracy or completeness of any information, test, or data is not warranted in any way. Rexarc is in no way responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account technical problems or traffic congestion on the Internet or at any Website or combination thereof including but not limited to injury or damage resulting from participation or downloading materials in connection with the training program and/or website.  Under no circumstances will Rexarc International, Inc., or any of it affiliates, advertisers, promoters or distribution partners be responsible for any loss or damage. Rexarc does not promise any specific results from taking our online training program.
  15. Other. This Agreement contains the entire agreement between you and Rexarc International, Inc., regarding the use of the Website and its Spec-Gas 101 online training program.  If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
